BREAKING: Federal Judge Strikes Down Trump’s Transgender Military Ban
Second blow for the administration today
A federal judge has ruled that Donald Trump’s ban on transgender individuals serving in the U.S. military is unconstitutional, delivering a major victory for LGBTQ+ rights. U.S. District Judge Ana Reyes found the ban violated the Equal Protection Clause, citing a 2020 Supreme Court ruling that discrimination against transgender people is illegal sex-based discrimination.
Trump’s 2017 policy reversed an Obama-era decision allowing transgender individuals to serve openly, forcing many service members to hide their identities or risk discharge. The administration falsely claimed the ban was necessary for military readiness despite Pentagon studies proving otherwise.
“This ruling is a triumph for transgender service members and the values of honor, integrity, and equality,” said Shannon Minter, Legal Director of the National Center for Lesbian Rights.
While President Biden repealed the ban in 2021, this ruling cements legal protections against future attacks on transgender rights. As Republicans escalate anti-LGBTQ+ policies nationwide, this decision serves as a potent reminder that discrimination will not stand.
