In a stunning rebuke of executive overreach, the U.S. Supreme Court today unanimously ordered the Trump administration to facilitate the return of Kilmar Abrego Garcia, a Maryland resident and father who was wrongfully deported to El Salvador despite a 2019 court ruling protecting him from removal.
The April 10 decision comes just three days after a sharply divided Court controversially allowed the administration to proceed with deportations under the Alien Enemies Act, an 18th-century statute revived to justify targeting alleged gang members with scant evidence and minimal due process.

But in this latest ruling, the Court stood united in defense of due process and human dignity. Abrego Garcia, who fled gang violence and sought asylum in the U.S., was inexplicably placed on a deportation flight last month and imprisoned in a Salvadoran maximum-security facility. His removal violated a standing immigration court order — a clear failure of the administration’s detention and removal machinery.
Justice Sonia Sotomayor, joined by Justices Kagan and Jackson, issued a blistering concurring opinion calling the government’s actions “unconscionable” and a dangerous precedent for unchecked deportation authority. Even the conservative justices concurred in the judgment, acknowledging the government’s obligation to remedy its error.
