What’s in the Lawsuit?
Bailey’s case hinges on the claim that Starbucks’ hiring and promotion policies unlawfully favor certain racial and gender groups. Specifically, the lawsuit targets:
Race-Based Hiring Goals – Starbucks has set internal benchmarks to increase the percentage of BIPOC (Black, Indigenous, and People of Color) employees in corporate and retail positions.
Tying Executive Pay to Diversity Targets – Company leadership is financially incentivized to meet racial and gender diversity goals.
Supplier Diversity Programs – Starbucks prioritizes contracts with minority-owned businesses, which Bailey argues discriminates against white business owners.
Board Diversity Requirements – The company’s commitment to maintaining racial and gender diversity on its board is framed as an unlawful hiring quota.
Missouri’s lawsuit claims these policies violate state and federal civil rights laws. It argues that any race or gender-based employment preference is illegal, even in the name of diversity. In addition, the AG argues that these practices lead to worse service and higher prices. Because a cappuccino made by a white barista costs less?
Similar legal attacks have already been launched against other companies, but courts have been inconsistent in their rulings, which could drag this lawsuit on for years.
Wasting Taxpayer Dollars on a Losing Battle
Legal fights against corporate giants aren’t cheap, and Starbucks has the resources to bury Missouri in litigation. If the state loses or settles, taxpayers could be stuck covering its own legal costs and Starbucks’ legal fees. Even a victory could be symbolic at best, as courts often hesitate to issue sweeping rulings that reshape corporate hiring policies.
Chilling Business, Stunting Growth
Missouri is sending a message: Companies that prioritize DEI could face state-backed legal action. Other GOP-led states have already taken this approach, and the result has been businesses pulling back on investments and reconsidering where to expand. Job creators may look elsewhere if Missouri earns a reputation for weaponizing the legal system against corporations.
A Bad Deal for Missouri
Win or lose, Missouri residents pay the price. States like Florida and Texas may be willing to gamble with taxpayer-funded ideological lawsuits, but Missouri can’t afford to waste resources on a political stunt. Instead of chasing headlines, Bailey should focus on policies that grow the economy and improve lives, not dragging a coffee chain into a costly courtroom battle.
