Brian Flores’ NFL Racism Lawsuit Moves Ahead After Supreme Court Rejects Appeal
The U.S. Supreme Court has declined to hear the NFL’s appeal in Brian Flores’ racial discrimination lawsuit, leaving key parts of the case in federal court rather than league-controlled arbitration.
Flores, a former Miami Dolphins head coach and current Minnesota Vikings defensive coordinator, sued the league in 2022, alleging racial discrimination in hiring and promotion practices. Former coaches Steve Wilks and Ray Horton later joined the case.

The legal fight centered on whether Flores’ claims should be heard in court or sent to arbitration under NFL rules. A federal appeals court previously rejected the league’s position for key claims, criticizing the structure of arbitration controlled by the league commissioner.
The Supreme Court’s move does not decide whether Flores’ discrimination claims are true. It means the NFL must continue fighting important parts of the case in open court, where discovery could examine hiring records and communications across the league.
