California Mother Sues School After Autistic Son Left Alone Near Pool
A California school district is facing a lawsuit after a nonverbal 4-year-old boy with autism was found face down in a school pool—despite requiring constant supervision.
The child’s family alleges staff at Lincoln Elementary in Ontario left him unattended for about 10 minutes, giving him enough time to reach the pool and nearly drown. According to the complaint, his individualized education plan required one-on-one monitoring at all times.

He was airlifted to a hospital after being discovered unresponsive, and now suffers from post-traumatic stress and reduced cognitive function, according to multiple reports.
The lawsuit claims staff failed to follow safety protocols and left the boy near pools without flotation support. According to the family’s attorney, the situation was a “catastrophic failure.”
The Ontario-Montclair School District has not commented publicly, citing ongoing litigation.
The case is raising new concerns about how schools supervise vulnerable special education students.
