Musk Ran DOGE Until the Lawsuits Came—Now the White House Says He’s Just an ‘Adviser’
The White House recently attempted a sleight of hand in response to mounting legal challenges against the Department of Government Efficiency (DOGE) and Elon Musk’s role. The administration, which had spent months portraying Musk as the mastermind behind DOGE, suddenly reframed his position. Now, Musk is not the de facto leader of DOGE, as previously implied—he is merely a “senior adviser” to President Trump.
This shift is not a mere clarification. It is a legal maneuver designed to insulate Musk and the administration from lawsuits questioning the constitutionality of DOGE and his role within it. The move came in response to a lawsuit filed by 14 Democratic-led states, which argued that Musk’s unchecked influence within DOGE violated the Appointments Clause of the U.S. Constitution.

At stake is whether the president, through an executive order, can install a billionaire tech mogul with sweeping powers to reshape the federal government without congressional approval or Senate confirmation. By rebranding Musk as an adviser, the White House attempts to weaken the case against him personally while maintaining his influence over government operations.
Trump’s Own Words Betray the White House’s Argument
The administration's legal claim that Musk is merely an "adviser" contradicts months of statements from both Trump and Musk himself.
In November 2024, President Trump announced that Musk would "lead DOGE" and oversee its efforts to streamline government operations. Musk embraced the role publicly, posting on X (formerly Twitter) about his direct involvement in reviewing federal agencies. The White House never corrected or clarified these statements until it became legally necessary to do so.
With lawsuits mounting, the White House is attempting to walk back those earlier claims to protect Musk from being directly implicated in legal challenges.
Musk, however, has not stopped acting like the head of DOGE. He has continuously posted on X about DOGE’s actions, often with cruel and mocking comments about government employees being fired or forced out. In several posts, Musk has outright called for firing officials who oppose DOGE’s agenda. His online behavior directly contradicts the administration’s claim that he is just an adviser.
If Musk is merely an adviser, then who is running DOGE? Who approved the mass purges of federal officials? Who authorized DOGE’s access to federal databases, including IRS and Office of Personnel Management records?
The administration has no clear answers because admitting Musk was in charge would validate the lawsuits against him.
An Unprecedented Purge of Federal Leadership
Since DOGE’s creation, many high-ranking federal officials have either resigned or been dismissed after resisting DOGE’s demands.
Agency Leadership That Has Been Ousted Following DOGE's Entry
Michelle King, acting commissioner of the Social Security Administration (SSA), resigned after refusing to grant DOGE access to sensitive Social Security beneficiary data.
Jim Jones, head of the FDA’s food division, resigned due to the impact of DOGE’s budget cuts, which he argued endangered food safety oversight.
David Lebryk, senior Treasury official, was placed on leave after opposing DOGE’s attempts to access the federal payment system.
Paul Martin, USAID's inspector general, was fired after publishing a report critical of the administration’s efforts to dismantle the agency.
The sheer scope of these firings and resignations is unprecedented. Never before has a presidential administration used an executive order to create a department that functions as a de facto purge mechanism for federal agencies.
Few agency heads were removed so aggressively and in such rapid succession during President Trump's first term. But DOGE, under Musk’s influence, has functioned as a political wrecking ball, reshaping the federal workforce with little oversight.
An Executive Order With No Precedent
While past presidents have reorganized executive agencies, such actions required congressional approval.
The Environmental Protection Agency (EPA) was created in 1970 through Reorganization Plan No. 3, which Nixon submitted to Congress. The Department of Homeland Security (DHS) was created in 2002 through an act of Congress, with strong executive backing from President Bush.
DOGE, however, was created entirely through executive order, with no congressional authorization or oversight. The result? An unaccountable agency wielding enormous influence over the federal workforce.
The administration's legal argument that Trump has unilateral authority to create such an agency is being directly challenged in court.
The Legal Front: Why the White House Reframed Musk’s Role
There are currently two main categories of legal challenges against DOGE and Musk.
1. Lawsuits Against DOGE & Musk Directly
These lawsuits argue that DOGE’s creation and Musk’s role within it are unconstitutional.
The 14-State Attorneys General Lawsuit
Arguments: Musk’s role violates the Appointments Clause because he wields executive power without Senate confirmation.
Current Status: Judge Tanya Chutkan denied an emergency injunction but noted the case has constitutional merit. It is moving forward.
Privacy Act Violations
Arguments: DOGE has illegally accessed federal databases containing taxpayer and employee data, violating the Privacy Act of 1974.
Current Status: Pending, with motions to dismiss filed by the administration.
2. Lawsuits Targeting Trump & The Executive Branch
These lawsuits go after the executive order, which could completely dismantle DOGE.
Challenge to the Executive Order Creating DOGE
Arguments: The president exceeded constitutional limits by unilaterally restructuring the federal workforce without congressional approval.
Current Status: Early stages, but this is the most dangerous case for the administration.
Final Thought: A Constitutional Crossroads
The White House’s legal gymnastics prove the administration knows it is on shaky constitutional ground. The attempt to reframe Musk’s role is not about transparency but legal survival.
If the courts allow DOGE to continue unchecked, it will set a dangerous precedent: a president could create any agency they wish, grant it sweeping powers, and install any leader they choose—all without congressional approval.
The courts must decide: does the executive branch have limits, or is Musk’s “advisory” role just the beginning of an unchecked presidency?
