Federal Appeals Court Strikes Down California’s Open-Carry Ban in Major Second Amendment Victory
A federal appeals court has blown up California’s ban on openly carrying firearms in most of the state, ruling the restriction unconstitutional under the Second Amendment and sparking a new flashpoint in the national gun debate. According to court filings, the 9th U.S. Circuit Court of Appeals on Friday struck down the law that barred open carry in populous counties, a decision that immediately reshapes how Californians may legally carry guns in public.
The ruling raises major constitutional stakes for the nation’s most populous state, coming just years after the U.S. Supreme Court’s landmark 2022 Bruen decision that altered how courts assess firearm regulations. Opponents of the law hailed the decision as a triumph for individual rights, while supporters warn it could increase visible guns on city streets.
In a 2–1 split, Judges Lawrence VanDyke and Kenneth Lee found California’s ban — which applied in counties home to about 95% of the state’s population — failed to satisfy the historical tradition test required under Bruen, because open carry was historically prevalent when the Second Amendment was adopted.

However, Judge N. Randy Smith dissented, arguing that because California still permits concealed carry statewide, the restriction on one method of public carry does not inherently violate the Constitution.
“The historical record makes unmistakably plain that open carry is part of this Nation’s history and tradition,” the majority opinion states.
The ruling could pave the way for more legal challenges to state gun laws and is expected to be reviewed by the full 9th Circuit or the U.S. Supreme Court. California officials have indicated they may appeal.
