Federal Judge Dismisses Kilmar Abrego Garcia Charges as Trump Immigration Cases Face Growing Court Challenges
A federal judge in Tennessee dismissed human smuggling charges against Kilmar Abrego Garcia on Friday, ruling the prosecution appeared retaliatory after Garcia challenged his deportation to El Salvador in federal court.
U.S. District Judge Waverly Crenshaw said the Justice Department likely would not have pursued the case if Garcia had not sued the government following his removal from the United States despite an earlier court order barring deportation to El Salvador because of gang-related safety concerns.
The criminal case centered on a 2022 Tennessee traffic stop in which Garcia was suspected of transporting undocumented migrants. He was not charged at the time. Prosecutors later revived the investigation after the Supreme Court ordered the government to facilitate his return to the U.S. following what officials acknowledged was an erroneous deportation.

Garcia’s attorneys argued the prosecution was politically motivated and designed to justify the administration’s earlier deportation actions. Judge Crenshaw said the timeline created a presumption of vindictive prosecution that prosecutors failed to overcome.
The ruling adds to mounting legal pressure surrounding Trump administration immigration enforcement policies.
Other federal courts have questioned attempts to detain Garcia indefinitely, challenged deportation efforts to third countries, and warned about due process concerns tied to aggressive removal policies.
The broader immigration litigation landscape now includes disputes over expedited deportations, detention authority, asylum protections, and executive enforcement power as multiple cases continue moving through federal courts.
The Justice Department has indicated it may appeal the dismissal.
