Florida Education Association Sues State Over Voucher and Charter School Programs
Florida’s largest teachers union and several parents have sued the Florida Department of Education, arguing that the state’s voucher and charter school systems violate Florida’s constitutional duty to maintain a uniform, safe and high-quality system of free public schools.
The lawsuit, filed by the Florida Education Association and individual plaintiffs, names Education Commissioner Anastasios “Stasi” Kamoutsas, the Department of Education, the State Board of Education and board members as defendants. The complaint challenges the Family Empowerment Scholarship Program and Florida’s charter school statute as currently administered.

The plaintiffs argue that public dollars are being sent to private, homeschool and charter settings that are not held to the same standards as traditional public schools. The filing asks a court to declare the programs unconstitutional as currently administered and block funding while alleged disparities remain.
Kamoutsas defended Florida’s universal school-choice policies, saying families should be able to choose the learning environment that fits their children.
