Georgia Election Board Reprimands Elon Musk’s America PAC for Violating State Law
Georgia’s State Election Board says Elon Musk-linked America PAC violated Georgia election law by mailing pre-filled absentee ballot applications to voters, and has issued a formal reprimand. The reprimand doesn’t carry criminal penalties — but it raises fresh questions about legal risks for the PAC and its voting-related outreach.
Board members said the absentee ballot applications were partially completed with voter information, which Georgia law prohibits unless distributed by a relative of the voter. The mailed forms also didn’t make it clear that they weren’t official government documents, another requirement under state election rules.
The board voted on the reprimand on Feb. 18. America PAC did not show up for the meeting and did not publicly respond to the board’s findings. Officials noted complaints from multiple counties, including Cherokee, Coweta, Floyd and Whitfield, where residents received the mailers ahead of the 2024 election.

This reprimand is procedural, not criminal, and the board’s statement did not allege voter fraud in the legal sense. It also didn’t impose fines or sanctions beyond the official warning issued to the PAC.
“It’s a violation of Georgia law to send pre-filled absentee ballot applications on behalf of third parties,” said an election board official, emphasizing the need to protect voters from confusion.
The matter matters because it represents one of the few formal state actions alleging election-law violations tied to America PAC’s voter outreach efforts — which have already drawn scrutiny in other states and at the federal level. Observers warn that even reprimands can form the basis of future legal or administrative enforcement.
What happens next is uncertain: Georgia could pursue further enforcement, and election watchdogs may push for deeper investigations into similar practices elsewhere.
