Harvey Weinstein Faces Third New York Trial After Jury Deadlock on Rape Charge
Harvey Weinstein is heading back to a Manhattan courtroom, with a judge setting April 14 for another rape trial tied to one of the last unresolved charges against the former Hollywood producer.
The new trial arrives after years of reversals, partial verdicts, and legal challenges that have kept the case active long after Weinstein’s original conviction.
According to court filings and reporting on the case, New York’s Court of Appeals overturned Weinstein’s 2020 rape conviction in April 2024, ruling that the trial judge improperly allowed testimony from women whose allegations were not part of the criminal charges.
Prosecutors retried the case in 2025. Jurors convicted Weinstein of one criminal sexual act involving former production assistant Miriam Haley, acquitted him of another charge, and could not reach a verdict on a rape allegation tied to actress Jessica Mann.

A judge later declared a mistrial on that remaining count after jurors failed to agree, clearing the way for another prosecution attempt.
Weinstein has denied the accusations, saying the encounters were consensual.
The case has remained one of the most closely watched legal battles tied to the #MeToo movement, which gained global momentum after dozens of women accused Weinstein of sexual misconduct beginning in 2017.
Even as the New York case continues, Weinstein remains imprisoned because of a separate 2022 conviction in California, where he was sentenced to 16 years for rape and sexual assault.

Legal analysts say the upcoming trial could hinge on how prosecutors present the remaining allegation under stricter evidentiary rules imposed after the appeals court ruling.
Jury selection is expected to begin shortly before the April trial date, with prosecutors again seeking a conviction on the unresolved rape charge.
For now, the long-running case is heading back to court once more.
