Harvey Weinstein Faces Third NYC Rape Trial Over 2013 Hotel Allegation
Harvey Weinstein is once again on trial in New York City, this time over a single rape allegation that jurors have already failed to resolve twice.
The retrial centers on Jessica Mann’s claim that Weinstein raped her in a Manhattan hotel in 2013, a charge left undecided after a hung jury in 2025, according to the Associated Press.
The case follows a complex legal path. Weinstein was originally convicted in 2020 and sentenced to 23 years, but that verdict was overturned in 2024 after an appeals court found improper testimony had been allowed.
In a 2025 retrial, jurors convicted him of a separate 2006 sexual assault involving Mimi Haley, but again failed to reach a decision on Mann’s allegation.
Now, prosecutors are presenting a narrower case focused only on Mann, while Weinstein’s new legal team signals a different defense strategy as proceedings begin in Manhattan.

“I never assaulted anyone,” Weinstein previously told the court while acknowledging he had “acted wrongly,” according to court reporting.
The retrial revisits accusations that helped ignite the global #MeToo movement, after more than 80 women came forward publicly in 2017 alleging sexual misconduct by the former film producer.
Prosecutors have consistently argued Weinstein used his influence in Hollywood to pressure women into sexual encounters, while defense attorneys claim the relationships were consensual and later reframed.
Weinstein, now in his 70s and facing health issues, is already serving a 16-year sentence from a separate California conviction, adding pressure to the outcome of this case.
The trial is expected to last several weeks, with testimony likely to revisit events from over a decade ago.
The unresolved question remains whether a third jury will finally reach a verdict.
