Hawaii Raises Minimum Wage to $16 as Cruise Ship Tax Hits Legal Roadblock
Hawaii began 2026 with a legal shake-up of its newly expanded tourist tax law as a federal appeals court temporarily halted enforcement of the cruise ship levy amid ongoing litigation. The move comes just as the state enacted broader tax increases and a wage hike that will directly affect visitors and workers alike.
The cruise industry’s challenge to the tax, including a lawsuit led by the Cruise Lines International Association has escalated into a constitutional battle, creating uncertainty over how Hawaii taxes transient visitors arriving by sea.
Act 96, signed by Gov. Josh Green last spring, raised Hawaii’s Transient Accommodation Tax from 10.25% to 11%, added a similar rate for cruise passengers prorated by days docked, and allows counties to tack on up to 3% more — potentially pushing total levies above 14%. Officials estimate nearly $100 million annually from these changes for climate resilience and environmental projects.
But on Dec. 31, the 9th U.S. Circuit Court of Appeals granted an injunction blocking the cruise ship portion of the law while appeals continue, after cruise lines and allied plaintiffs argued it violates federal constitutional restrictions on state taxation of maritime commerce.

“We remain confident that Act 96 is lawful and will be vindicated when the appeal is heard on the merits,” a Hawaii attorney general spokesperson said in an email.
Alongside the tourism levy, Hawaii’s minimum wage rose to $16/hour on Jan. 1, representing a major increase for workers across the islands.
The temporary court injunction means cruise operators won’t collect the passenger tax for now, even as the state proceeds with higher hotel and rental levies and new labor standards.
The next major development will come when the 9th Circuit hears full arguments on the merits of the suit, setting the stage for a broader ruling on the legality of Hawaii’s first-of-its-kind tourist tax on cruise travelers.
