Illinois and Chicago Sue Trump Administration Over Federal Immigration Agents’ ‘Lawless’ Tactics
Illinois and the City of Chicago officially confirmed Monday that they have taken legal action against the federal government over immigration enforcement tactics in the state.
The lawsuit filed by Illinois Attorney General Kwame Raoul and Chicago alleges that federal immigration agents from DHS, CBP and ICE have used unconstitutional and dangerous tactics in communities across Illinois, creating public safety concerns and violating residents’ rights.
According to the Office of the Illinois Attorney General, the complaint filed in the U.S. District Court for the Northern District of Illinois claims agents have conducted warrantless arrests, interrogations without probable cause, and used tear gas and other chemical agents against people in residential areas.
State officials argue the presence and conduct of federal agents goes beyond authorized immigration enforcement, with Raoul saying agents have “acted as occupiers rather than officers of the law” and undermined state sovereignty.

Illinois Governor JB Pritzker also backed the lawsuit, saying the state must hold federal authorities accountable for what he described as “unlawful tactics” and threats to public safety.
The lawsuit specifically names Department of Homeland Security Secretary Kristi Noem, ICE Director Todd Lyons, CBP leadership and others as defendants, seeking judicial limits on federal agent activities in Illinois.
Legal experts say the case could test state authority under the 10th Amendment and challenge the scope of federal immigration enforcement powers when conducted deep inside a state without clear statutory limits.
A spokesperson for DHS has called the lawsuit “baseless,” asserting that federal immigration efforts are lawful and necessary.
