Jack Smith Says His Team Has “Proof Beyond a Reasonable Doubt” Trump Tried to Overturn 2020 Election
Washington — Former special counsel Jack Smith told Republican lawmakers he could prove that Donald Trump engaged in a criminal scheme to overturn the 2020 election, according to portions of his testimony obtained by news outlets from a closed-door hearing Wednesday.
Smith’s private deposition before the House Judiciary Committee highlighted deep political tension over his high-profile Trump investigations, which include efforts to overturn the election and mishandling of classified documents.
According to the Associated Press, Smith said his investigative team “developed proof beyond a reasonable doubt” that Trump conspired to overturn the election and that investigators also found “powerful evidence” Trump willfully retained classified documents at his Mar-a-Lago estate and tried to hide them from authorities.
Smith told lawmakers he made every prosecutorial decision without regard to Trump’s political association or beliefs and that the legal basis for charges came solely from Trump’s alleged actions.

Smith was subpoenaed by the Republican-controlled committee after offering to testify publicly; lawmakers instead heard his testimony in private, driving partisan criticism on both sides.
“It’s not about politics — it’s about what the facts and the law required,” Smith told committee members, according to excerpts of his statement.
The closed session represents the most detailed defense Smith has offered lawmakers of his work prosecuting Trump and defending decisions that have sparked fierce national debate.
Republicans continue to argue the investigations were politically motivated, while Democrats say Smith’s evidence shows serious legal issues that merit closer public scrutiny.
