Sauer is a darling of the Federalist Society, a zealous originalist, and former Missouri Solicitor General. But his role in Trump v. United States—now before the Supreme Court—vaulted him into national attention.
In that case, Sauer claimed former presidents enjoy sweeping criminal immunity, even for crimes committed in office. At oral arguments, he dropped one of the most chilling hypotheticals ever uttered in the Supreme Court:
“There is no constitutional basis for prosecuting a president for official acts, even if those acts include ordering the military to assassinate a political rival.”
Yes, he said that.
Yet the Senate confirmed him.
Senator Sheldon Whitehouse (D-RI) called the appointment,
“A catastrophic elevation of a man who just argued that democracy itself must yield to the will of a single man in power.”
Now, that man becomes the voice of the U.S. government before the highest court in the land.
What Does the Solicitor General Actually Do?
The Solicitor General—sometimes called the “Tenth Justice”—is no ordinary bureaucrat. The SG:
