Judge Reverses Course, Orders Hearing on Mangione Backpack Search
A federal judge has reversed course and ordered a hearing to examine whether key evidence seized during the arrest of Luigi Mangione was lawfully obtained.
U.S. District Judge Margaret Garnett on Monday ruled that a limited evidentiary hearing will be held to review the Altoona Police Department’s procedures for handling Mangione’s property at the time of his arrest in Pennsylvania. The decision marks a change from the judge’s earlier stance last week, when she indicated a hearing was unnecessary.
The hearing will focus specifically on the search of Mangione’s backpack, which prosecutors say contained critical evidence linking him to the December 2024 shooting death of UnitedHealthcare CEO Brian Thompson in Midtown Manhattan. Only one senior police officer will testify, a narrower scope than the full suppression hearing requested by the defense.

Mangione, 26, was arrested on December 9, 2024, at a McDonald’s in Altoona after being identified from wanted posters. Authorities allege the backpack contained a firearm with a suppressor, ammunition, fake identification, and a notebook referencing grievances against the health insurance industry. Mangione has pleaded not guilty.
Defense attorneys argue the search violated Mangione’s Fourth Amendment rights and that the evidence should be excluded. Prosecutors counter that the search was lawful under standard arrest and property-handling procedures.
No hearing date has been set. Both sides have been instructed to propose scheduling options.
The case remains in federal court, where Mangione faces charges that could carry severe penalties if convicted.
