Judges Let Fired Federal Workers Challenge Trump Dismissals in Court
Two federal judges have ruled that some federal employees fired under the Trump administration can challenge their dismissals directly in federal court, bypassing the standard civil service appeals system.
The decisions involve former Justice Department attorney Maurene Comey and former FEMA official Mary Comans, both of whom were dismissed with termination notices citing only presidential Article II authority. Judges in New York and Virginia said those claims place the firings outside the normal Merit Systems Protection Board process.
The rulings do not determine whether the firings were lawful. Instead, they decide where the cases can be heard — a threshold issue that could shape dozens of similar lawsuits.
