Missouri Supreme Court Refuses to Reinstate Abortion Ban, Leaving Access Standing
Missouri’s Supreme Court refused to take up the state’s bid to immediately reinstate its abortion ban and related restrictions, keeping legal abortion services available as a major trial approaches. The decision matters now because it blocks a fast-track effort to curb access ahead of the January trial.
The tension between Missouri’s Republican attorney general and the state’s judiciary has escalated since voters approved a constitutional amendment protecting abortion rights in November 2024. Attorney General Andrew Bailey had asked the Supreme Court to overturn a lower court injunction that halted enforcement of multiple anti-abortion laws.
According to Missouri Independent, the Supreme Court ruled unanimously that Bailey “erred” by asking the justices to hear the case before it passed through the court of appeals. The justices sent the matter back, meaning abortion access remains intact for now while the legal process continues.
The injunction from Jackson County Circuit Judge Jerri Zhang was issued after Planned Parenthood affiliates and the ACLU challenged longstanding abortion restrictions as unconstitutional under the 2024 reproductive rights amendment.

This latest refusal comes after a Western District Court of Appeals recently denied the attorney general’s request to reinstate several regulations, allowing Planned Parenthood clinics in Kansas City, Columbia and St. Louis to continue offering procedural abortions.
“It was not appropriate for the Supreme Court to leapfrog the appeals process,” said a legal analyst familiar with the case, underscoring the procedural ruling. The full merits of Missouri’s abortion laws will now be decided at trial in January 2026.
The ruling leaves Missouri’s abortion rights amendment effectively in force for now, forestalling a return to stricter limits. Legal teams on both sides say they are preparing for the bench trial that will determine whether the restrictions can legally stand.
In January, Judge Zhang is expected to hear full arguments on the constitutionality of the contested laws. The outcome will shape abortion access in Missouri through the next legislative cycle, potentially influencing 2026 ballot measures.
