Rep. Thomas Massie Demands Release of Jan. 6 Pipe Bomb Suspect, Sparks Legal Clash
Rep. Thomas Massie (R-Ky.) on Tuesday publicly urged a federal judge to release January 6 pipe bomb suspect Brian Cole Jr., calling the evidence “flimsy,” asserting Cole poses “danger to no one,” and claiming the Department of Justice mishandled the legal work. According to Massie’s post on X, the congressman wrote that Cole should be released with conditions such as a tracker and house arrest.
Massie’s statement escalates a conflict between a vocal GOP lawmaker and federal prosecutors over a case rooted in the explosive devices found outside the Republican and Democratic National Committee headquarters on Jan. 5, 2021, the night before the Capitol riot.
Cole, 30, of Woodbridge, Virginia, was arrested in December 2025 and is charged with transporting explosive devices across state lines and attempting their use. Prosecutors presented surveillance footage, purchase records for bomb-making components, and an alleged confession in court filings as part of their case for detention.

Despite defense arguments that Cole’s autism diagnosis, lack of prior record, and offer of house arrest with electronic monitoring mitigate risk, a federal magistrate judge recently denied release, finding no conditions would “reasonably assure the safety of the community.”
“It was luck, not lack of effort, that caused the bombs not to explode,” the judge wrote in a ruling cited by court reporting.
Massie’s call comes as the case remains deeply polarized, with prosecutors emphasizing public safety risk and supporters highlighting questions around motives and evidence. The defense is expected to pursue further legal motions this week as pretrial detention status continues to be litigated.
The next hearing in the case is scheduled within days, with the judge poised to address unresolved procedural issues and further defense arguments.
