Tennessee GOP Lawmakers Advance Measure Linking Abortion to Death Penalty Law
A Tennessee House panel has advanced a bill that would classify abortion as homicide, potentially exposing women to the state’s most severe criminal penalties, including capital punishment.
The proposal immediately intensified debate in a state that already enforces one of the strictest abortion bans in the country.
According to The Tennessean, House Bill 1663 would remove current language that protects women from criminal prosecution and instead apply Tennessee’s homicide statutes to abortion cases. Under existing law, certain homicide convictions can carry the death penalty.
Supporters say the measure is designed to ensure abortion is treated consistently with other forms of homicide under state law. Opponents argue it represents a dramatic escalation that could subject women to life imprisonment or execution.
WKRN reports the bill advanced through the House Criminal Justice Subcommittee despite concerns raised by legal analysts about its constitutional durability. Tennessee’s Human Life Protection Act already prohibits nearly all abortions except in limited medical emergencies.
“This bill would align abortion with our homicide statutes,” a Republican sponsor said during committee debate.

The move places Tennessee at the center of a renewed national clash over abortion enforcement, as states test the outer limits of post-Roe authority. The bill now proceeds to additional committee hearings, where lawmakers will determine whether it advances to a full House vote.
