Texas Ignites New Battle: SB 8 ‘Bathroom Bill’ Forces Schools and Agencies Into Costly Compliance War
Texas- Today marks the activation of Texas Senate Bill 8, the state’s new “bathroom bill,” which requires restrooms, locker rooms and other multi-user changing facilities in publicly owned buildings to be designated according to a person’s sex assigned at birth. According to reporting from Click2Houston and the Texas Tribune, the law applies to public schools, state universities, city and county buildings, prisons and certain shelters, while private businesses remain exempt and may continue setting their own restroom policies.

Institutions that fail to comply face significant financial penalties. Fox 7 Austin reports that agencies or schools could be fined $25,000 for a first violation and $125,000 for each additional day they remain out of compliance. The law does not impose criminal penalties on individuals using a restroom that does not align with their birth-assigned sex, but instead places enforcement responsibility on the public institutions that manage the facilities.
Supporters argue the law strengthens privacy and safety standards in sex-segregated spaces. The Texas Tribune notes that backers of SB 8 framed the measure as a straightforward regulation to ensure consistency across public buildings. Civil rights groups, including the ACLU of Texas, strongly oppose the law, saying it discriminates against transgender, intersex and nonbinary people and could increase harassment or “gender policing” in public settings.
Some Texas campuses have already begun making adjustments. KSAT reports that the University of Texas at San Antonio reassigned certain students to new dorm rooms to match restroom and housing rules required under SB 8. Schools and agencies statewide continue drafting compliance plans as the law takes effect. With enforcement details still unclear, advocates and legal experts expect potential court challenges as implementation unfolds.
