Two tiered justice predates Trump by a long, long time. Also I frame it a bit differently.
There are two systems of justice:
One to protect the presumed innocent.
And one to persecute the assumed guilty.
Very definitely should have been taught better in US schools, but is still an excellent system, in spite of having been badly subverted.
