Lindsey Halligan has exited her role as interim U.S. attorney for the Eastern District of Virginia after days of mounting legal rebukes that undercut her authority. According to the Department of Justice and federal court records, Halligan’s departure came hours after a federal judge labeled her continued use of the title a “charade,” underscoring the turmoil engulfing her brief tenure.
The exit elevates a clash between the executive branch and the federal judiciary over how long interim prosecutors can serve without Senate confirmation, fueling broader political and legal conflict.
Multiple judges had opposed Halligan’s continuation in office after a 2025 ruling declared her appointment unlawful because her 120-day interim term had lapsed. U.S. District Judge David J. Novak, appointed by Trump, explicitly warned that any DOJ attorney who continued to describe her as U.S. attorney could face disciplinary sanctions, calling it a “charade.”
She had been appointed in September 2025 with presidential backing and pursued politically charged cases against former FBI Director James Comey and New York Attorney General Letitia James, but those indictments were dismissed after the judge’s legality ruling.

“The circumstances that led to this outcome are deeply misguided,” Attorney General Pam Bondi wrote on social media, asserting Senate opposition blocked confirmation.
The departure matters because it highlights increasing judicial resistance to executive appointments made without Senate vetting, a trend affecting several Trump-aligned U.S. attorneys nationwide.
Justice Department appeals of the legality ruling remain pending, and the U.S. Attorney’s Office for the Eastern District of Virginia is now accepting expressions of interest for its leadership vacancy.
