Trump DOJ Doubles Down on Powell Probe as Tillis Blocks Warsh Nomination
A federal judge’s decision blocking the DOJ’s probe into Federal Reserve Chair Jerome Powell is now triggering an appeal fight that could stall Kevin Warsh’s nomination indefinitely.
The ruling has intensified a standoff between the Trump administration and Senate Republicans, with Sen. Thom Tillis refusing to support Warsh unless the investigation is dropped.
According to Reuters, the court found no credible evidence supporting subpoenas tied to the probe, which focuses on renovation cost overruns and Powell’s congressional testimony. Prosecutor Jeanine Pirro has signaled she will appeal, extending the legal battle.
That move complicates the timeline as Powell’s term nears its end, raising new uncertainty about leadership at the Federal Reserve.
Tillis has made his position clear: “If we want to get Mr. Warsh confirmed, we need to drop the investigation,” he said, according to Fox Business.

The impasse is now exposing deeper fractures inside the GOP, where some lawmakers argue the probe is politically motivated while others, including former President Donald Trump, continue backing it.
Because Republicans hold only a narrow majority on the Senate Banking Committee, Tillis’ opposition is enough to block Warsh from advancing, leaving the nomination effectively frozen.
Meanwhile, Trump has shown little willingness to intervene, despite calls from party leaders to resolve the dispute and stabilize economic policy leadership.
Legal analysts say the appeal could drag on, and even if the subpoenas remain blocked, the investigation itself may continue in other forms.
That leaves Warsh’s path forward dependent not on Senate votes alone, but on whether the DOJ backs down or doubles down.
For now, the nomination remains stalled with no clear resolution in sight.
