Trump Lawyer Demands Judge’s Removal in Wisconsin Fake Electors Prosecution
Madison, Wis. — President Donald Trump’s ex-attorney in Wisconsin and two former Trump aides accused the judge overseeing their 2020 “fake electors” case of judicial misconduct Monday, alleging the court cannot fairly try them and seeking his removal as their preliminary hearing approaches. According to The Associated Press, the trio says the judge’s actions show bias and must be addressed before the case moves forward.
The allegation puts fresh tension into a politically charged prosecution tied to the 2020 election, where the defendants are accused of submitting forged electoral paperwork claiming Trump won Wisconsin. Prosecutors have urged the court to keep the schedule intact.
Jim Troupis, who served as Trump’s attorney in Wisconsin during the 2020 campaign, joined attorneys Kenneth Chesebro and Mike Roman in filing a motion asking that the Dec. 15 preliminary hearing be postponed and that the judge be disqualified and the matter moved to another county. Details about the claimed judicial misconduct remain sealed and have not been publicly disclosed.
On Tuesday, Dane County Circuit Judge John Hyland refused to step aside or cancel the hearing, saying there was no evidence he was tainted or unable to be impartial, and the schedule remains unchanged.
The three defendants each face 11 felony counts of forgery, punishable by years in prison and fines, for allegedly attempting to defraud 10 Republican electors into signing false certificates asserting Trump won the state in 2020 — a result he lost.
