Trump Pushes Supreme Court to Rewrite 14th Amendment in Citizenship Fight
The Supreme Court is about to hear one of the most consequential immigration cases in decades, but lower courts have already rejected the policy at the center of it.
According to AP News and SCOTUSblog, justices will review a Trump-era executive order that would deny automatic citizenship to some U.S.-born children based on their parents’ immigration status.
That directly challenges the long-standing interpretation of the 14th Amendment, which has granted birthright citizenship for over a century.
Federal judges across multiple states have already blocked the order, calling it likely unconstitutional and inconsistent with Supreme Court precedent.

But the administration argues the Constitution was misinterpreted and that not all children born on U.S. soil are “subject to jurisdiction.”
The case could impact more than 250,000 children born each year, according to AP reporting.
It also comes amid escalating political pressure, with Trump criticizing the courts ahead of arguments.
A final ruling, expected by summer, could redefine who qualifies as an American citizen.
