Donald Trump just told reporters on Air Force One that he’d be “allowed” to run for a third term—something the Constitution clearly forbids. While Trump smirked through his “too cute” answer, his allies like Steve Bannon are already testing how far they can stretch the language of the 22nd Amendment. Their argument hinges on one word: elected. Bannon’s theory suggests that if Trump can simply get on the ballot—and the people vote for him—then the election itself overrides the amendment. It’s a cynical reading of democracy, and it’s exactly how authoritarian movements try to normalize the unthinkable.
The Twelfth Amendment also closes the door on Trump’s idea of running as a vice president first and stepping into the Oval Office later.
